Terms of Service

1. Agreement and Operator

These Terms of Service are a legal agreement between you and Lorie A. Sprague, a sole proprietor doing business as Galactic English Tutoring, operator of Stellify Kids (“Stellify Kids,” “we,” “us,” or “our”). They apply to www.stellifykids.com and the related learning platform.

By creating an account, purchasing a plan, authorizing a child's account, or using Stellify Kids, you agree to these Terms and our Privacy Policy. If you accept for an organization or child, you represent that you have authority to do so. If you do not agree, do not use the service.

2. What Stellify Kids Provides

Stellify Kids is an educational platform for independent teachers, families, and young learners. It may include live classrooms, audio and video meetings, a supervised co-browser, interactive activities, lesson and homework tools, learning progress, achievements, classroom highlights, original Galactic English materials, links to independent curriculum resources, and AI-assisted content.

The platform may support English, mathematics, science, test preparation, and other subjects. Features, subjects, and availability may change as the service develops. Stellify Kids provides technology and educational tools; it does not guarantee a particular academic result, examination score, or learning outcome.

3. Eligibility and Accounts

  • Adult users must provide accurate information, keep credentials confidential, and promptly report suspected unauthorized access.
  • Children may use Stellify Kids only through an account created or authorized by a parent, legal guardian, teacher, or school with the authority and consent required by applicable law.
  • A student must not independently create an adult account, purchase a plan, or misrepresent age or identity.
  • Each adult account is personal and may not be shared with unauthorized users. Teachers must use separate student profiles and must not reuse one student's credentials for another child.
  • You are responsible for activity performed through your account, except activity caused by our own failure to use reasonable security.

4. Responsibilities by Role

  • Teachers: You must obtain and document required parent or guardian authorization before adding a minor; provide age-appropriate instruction; supervise classroom and co-browser activity; safeguard student information; review AI-generated material; use only content you are permitted to use; and comply with child-safety, privacy, education, and professional obligations that apply to you.
  • Parents and guardians: You authorize and supervise your child's use, provide accurate information, keep family login details secure, review relevant classroom and highlight notices, and tell us or the teacher when authorization changes.
  • Students: You must follow teacher instructions, use the service respectfully and for learning, protect your PIN, and tell a trusted adult if anything feels unsafe or inappropriate.
  • Administrators: Stellify Kids may access limited account or content information when needed for support, safety, legal compliance, reported-content review, fraud prevention, or service administration.

Independent teachers are responsible for the instruction, schedules, materials, and professional services they offer. Unless expressly stated otherwise, they are not employees or agents of Stellify Kids.

5. External Curriculum Resources

Stellify Kids may provide convenient teacher-resource links to independent curriculum websites, currently including Florentis Learning, Young Learners Curriculum, and Abridge Academy. These are separate services. Each teacher must create, purchase, and manage a personal account directly with the provider and follow that provider's license, terms, and privacy policy. Stellify Kids does not provide, sublicense, or resell those curriculum accounts.

Teachers may open an authorized lesson through the Stellify Kids co-browser so students can view and interact with it under supervision. Teachers must not create external curriculum accounts or profiles for Stellify students and must not enter or upload student-specific personal information to those sites. This prohibition includes names, initials, recognizable nicknames, dates of birth, exact ages, contact or parent information, Stellify Kids credentials or PINs, individually linked levels, learning weaknesses, lesson notes, progress, assessments, messages, photos, recordings, or highlight clips.

An external site may receive ordinary technical requests, cookies, and page interactions from the remote browser. Stellify Kids does not control the external site's content, policies, availability, or security and is not responsible for purchases or disputes between a teacher and that provider.

6. Live Classrooms, Co-Browsing, and Screen Broadcasts

  • Agora is used for live audio, video, and screen-broadcast functions. Hyperbeam is used for the shared remote browser.
  • A screen broadcast is primarily a view of the teacher's screen. Direct student interaction with third-party lesson activities must occur through the co-browser or another feature specifically designed for interaction.
  • Teachers control classroom permissions and are responsible for admitting students, granting or revoking browser or annotation controls, and monitoring activity.
  • Users must not use the co-browser to access unlawful, unsafe, sexually explicit, violent, exploitative, or otherwise inappropriate material, or to evade a website's access controls or license terms.
  • Connection quality depends on the user's device, network, location, and third-party capacity. Temporary delay, reconnection, reduced quality, or service interruption may occur.

7. Classroom Highlights

Stellify Kids does not record an entire class by default. A teacher may deliberately capture short highlight clips for educational feedback, progress documentation, or a student's private Highlights area. The teacher must ensure that required notice and authorization exist before recording a child.

Temporary clips remain private while awaiting teacher review. The teacher may approve or delete each clip. An approved clip may be added to the appropriate student's private dashboard and may be attached to a progress report where that feature is available. Teacher approval is normally sufficient; administrator review is optional and limited to reported or flagged content, onboarding or occasional compliance checks, and suspected safety, privacy, or policy concerns. Stellify Kids may remove or restrict any clip when reasonably necessary.

8. AI-Assisted Features

  • AI features may generate lesson plans, activities, passages, feedback, homework, adventure content, or other educational drafts.
  • AI output can be incomplete, inaccurate, biased, or unsuitable. A teacher must review and adapt it before presenting or assigning it to a student.
  • Users must not place unnecessary sensitive personal information in prompts or use AI features to make high-impact or solely automated decisions about a child.
  • AI features do not replace qualified teaching judgment or professional medical, psychological, legal, or special-education advice.
  • Availability and model providers may change. Our Privacy Policy explains the limited learning context that may be processed when an AI feature is used.

9. Subscriptions, Payments, and Cancellation

  • Available plans, limits, billing periods, and prices are shown before purchase and may differ for teachers and families.
  • Stripe processes payments. You authorize applicable recurring charges until cancellation.
  • You may cancel through the available billing controls or by contacting us. Unless stated otherwise at purchase, access continues through the paid billing period and does not automatically renew after cancellation.
  • Except where required by law or expressly promised at purchase, processed subscription fees are non-refundable.
  • We may change future pricing or plan features with reasonable advance notice. A price change does not retroactively alter a completed billing period.

10. Content, Licenses, and Ownership

  • Your content: You keep ownership of original materials you upload. You grant Stellify Kids a limited, non-exclusive license to host, process, display, and transmit them only as needed to operate, secure, and support the service.
  • Student work: Student-created work remains owned by the student or applicable rights holder. It may be used only for authorized educational and platform purposes.
  • Stellify Kids content: The platform, branding, software, original Galactic English curriculum, graphics, teacher guides, workbooks, flashcards, recordings, assessments, games, and other original materials are owned by Stellify Kids or its licensors. A subscription gives only the limited access and use rights stated for that plan.
  • Third-party content: Curriculum resources, videos, websites, and other third-party materials remain subject to their owners' rights and licenses. Access through Stellify Kids does not grant permission to copy, download, redistribute, or publicly perform them.
  • AI output: Rights in AI-assisted output may depend on applicable law, the model provider's terms, the input material, and the user's human authorship. We do not guarantee that an output is unique, copyrightable, or free of third-party rights. Teachers must review and substantially adapt material as appropriate.

11. Acceptable Use

You must not:

  • Harass, bully, exploit, groom, threaten, discriminate against, or endanger another person.
  • Upload or display unlawful, infringing, deceptive, malicious, sexually explicit, violent, or age-inappropriate material.
  • Share student information outside authorized educational purposes or place it on external curriculum sites contrary to these Terms.
  • Record, screenshot, download, disclose, or publish another person's classroom media or private content without proper authorization.
  • Attempt to hack, scrape, overload, reverse engineer, disrupt, or bypass platform, co-browser, account, payment, or third-party access controls.
  • Use bots or automated tools except through a feature or written permission we provide.
  • Use Stellify Kids for advertising to children, unlawful surveillance, or any non-educational commercial exploitation of student data.

12. Privacy and Security

Our Privacy Policy explains our data practices. Users must follow all applicable privacy and child-safety requirements and must promptly report suspected unauthorized access, data exposure, or unsafe conduct. No internet service is completely secure, and not every feature is end-to-end encrypted.

13. Availability and Third-Party Services

We aim to keep Stellify Kids reliable, but we do not guarantee uninterrupted or error-free availability. We may maintain, modify, suspend, or discontinue a feature, and will provide reasonable notice when practical. Floot infrastructure, Agora, Hyperbeam, Stripe, AI providers, curriculum websites, internet providers, and user devices are separate systems whose outages or changes may affect the service.

14. Suspension, Account Closure, and Data Requests

  • We may restrict or suspend an account when reasonably necessary to protect children, users, the platform, or third parties; investigate misuse; comply with law; or address a material breach of these Terms.
  • An adult user may cancel a subscription and may request account closure or eligible data deletion by contacting hello@stellifykids.com.
  • Some in-platform actions archive or deactivate records rather than immediately erasing them. Archiving is not permanent deletion.
  • Closing a parent account may unlink the parent while a child's teacher-managed educational record remains active. Closing or suspending a teacher account does not automatically erase every student or transaction record.
  • Verified privacy requests are handled under the Privacy Policy, subject to lawful retention, security, fraud-prevention, backup, and transaction-record requirements.

15. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Stellify Kids is provided “as is” and “as available,” without warranties that every feature, third-party resource, AI output, or educational result will meet your needs. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.

To the maximum extent permitted by law, Stellify Kids and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by user conduct, external curriculum providers, third-party outages, unauthorized use contrary to these Terms, or unreviewed AI output. Our total liability for a claim relating to a paid service will not exceed the amount you paid Stellify Kids for that service during the 12 months before the event giving rise to the claim.

16. Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict-of-law rules. Courts with jurisdiction in Alabama will hear disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere.

17. Changes to These Terms

We may update these Terms as the platform, providers, or legal requirements change. We will post the updated date and provide additional notice for material changes. If renewed consent is required, we will request it. Continued use after the effective date means acceptance where permitted by law.
